Terms and Conditions

1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the website at www.kctreeworks.com (the "Site") and any services provided by KC Tree Works LLC ("we," "us," or "our"). By using the Site or submitting a free estimate request, you agree to these Terms. If you do not agree, please do not use the Site.
2. Our Services
KC Tree Works LLC provides tree care and related services, including tree trimming, tree removals, stump grinding, storm cleanup, land clearing, crane services, and tree planting, primarily in and around Gardner, Kansas. Service availability may vary based on location, scheduling, weather, and site conditions.
3. Free Estimates
We offer free estimates for tree care services to customers in our service area.

No cost, no obligation. Requesting and receiving a free estimate costs you nothing, and you are under no obligation to purchase any service.

How estimates are prepared. A free estimate may be based on the information and photos you provide, a phone conversation, and/or a no-charge on-site visit, depending on the scope of the work and our availability.

What is included. The free estimate covers a description of the proposed work and a price for that work based on visible conditions at the time of assessment.

What is not included. The free estimate does not include paid professional services such as written arborist reports, tree risk assessments, soil or lab testing, engineering or permit drawings, or permit and utility locate fees, unless we separately agree to provide them.

Validity period. Estimates are valid for 30 days from the date issued unless otherwise stated in writing or unless conditions change materially (for example, storm damage, tree decline, or changes in material or disposal costs).

Service area. Free estimates are offered within our normal service area. Requests from outside that area may be declined or may require different arrangements, which we will discuss with you.
4. Estimates Are Not Binding Contracts
Requesting or receiving a free estimate does not create a binding contract and does not guarantee service availability, scheduling, or final pricing.
Free estimates are preliminary and based on the information available at the time they are prepared. Final pricing may change after an on-site assessment or if conditions differ from what was described, including but not limited to:

Tree size, species, health, or location

Access limitations or obstacles

Proximity to structures, power lines, or other hazards

Underground utilities or root conditions

Weather or emergency conditions

Changes requested by the customer
A service agreement is formed only when both parties agree on the scope of work and price.
5. Scheduling and Cancellations
Scheduling is subject to availability and may be affected by weather, equipment, or emergencies. We will make reasonable efforts to communicate schedule changes. If you need to reschedule or cancel, please contact us as soon as possible so we can adjust our schedule.
6. Payment Terms
Payment terms, including any deposit requirements and accepted payment methods, will be provided with your service agreement or invoice. Unless otherwise agreed in writing, payment is due as stated on your invoice. Late or unpaid balances may be subject to collection efforts permitted by law.
7. Customer Responsibilities and Property Access
To perform services safely and efficiently — and to keep your free estimate accurate — you agree to:

Provide accurate information about the property and the work requested, including photos where helpful

Provide reasonable access to the work area, including driveways, gates, and yards

Remove or secure vehicles, pets, and personal property from the work area

Disclose known hazards, including underground utilities, septic systems, sprinkler lines, or electrical lines

Obtain any permissions required from property owners, HOAs, or other parties
You are responsible for ensuring you have the authority to request work on the property.
8. Permits and Utility Locates
Where required, permits and utility locates are the responsibility of the property owner unless we agree otherwise in writing. We will not be responsible for damage to unmarked underground utilities or private lines that were not disclosed.
9. Risks and Liability
Tree work involves inherent risks, including falling limbs, equipment operation, and property access. While we take reasonable safety precautions, you acknowledge that tree care carries risks that cannot be entirely eliminated.
To the fullest extent permitted by law, KC Tree Works LLC is not liable for indirect, incidental, special, or consequential damages arising from the use of the Site or from services provided. Our total liability for any claim related to services will not exceed the amount paid by you for the specific services giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Insurance
KC Tree Works LLC maintains insurance coverage appropriate for its operations. Certificates of insurance are available upon request.
11. Website Use
You agree to use the Site only for lawful purposes. You may not:

Attempt to gain unauthorized access to the Site or its systems

Interfere with the Site's operation or security

Submit false, misleading, or fraudulent information through any form

Use the Site to harass, abuse, or harm others
